Oily ball joint. MOT Fail??

Oily ball joint. MOT Fail??

Hi all on this lovely sunny evening.
Its MOT time , and after a check around, i noticed the ball joint at the bottom of the steering knuckle is obviously split ,and is oily. but there is no play, Shaking wheel in all directions, and everything is nice n tight. Is this still a fail.???

Much to my surprise I found a split boot on such a joint is not a fail but play would be so you should be ok. Mine was like that when I got it 7 years ago and has passed ever since. Now I've said that it will prob fail in June when it's due...

Good news, Cause whoever changed the last 1, put a rounded hex bolt back in the top joint. and it will be murder to remove.
