Of course it's illegal, so are many things like the under age kids who rag around restricted lanes on illegal bikes.
Problem is if everyone makes a song and dance every time some knumpty wants to do their own thing it highlights the issue so the knee jerk reaction is a clampdown on everyone as we all get tarred with the same brush legal or not.
If pressure finaly closes green lanes due because of the high profile antics of idiots, these people are still going to do what they want anyway.
Highligting it is only going to start some copy cat "wow that's fun, lets do that" attitude. So punish them correctly, keep it quiet and work in the back ground for responsible off-roading.

I can't say I agree with the fact he's having the book thrown at him for 'Dangerous driving' rather than 'Operating a motor vehicle other than on a highway' which would be the case if it was any other footpath/bridleway and not Snowdon.
